Third party interventions in judicial review (2001)

This action-research study investigated the potential for third party interventions in civil judicial review applications raising public interest issues. The findings of this project were published in a report which identified the main factors inhibiting third party interventions by public bodies, apart from the practical barriers of expedition, settlement and withdrawal of claims. These include lack of knowledge of relevant cases on the part of potential interveners, lack of knowledge about how to intervene and the risk of liability for costs. The report includes recommendations for overcoming these barriers, as well as a public interest checklist and an information pack for interveners.
